Working in sales, medieval Muslim style. A short history of some of the most controversial commutative contracts in Islamic economics<\/p>\n

Annotation<\/strong><\/p>\n

Bay\u02bfsalam\/salaf\u00a0\u2013 as sale of an object with a future delivery and on-spot payment \u2013 is arguably one of the most curious ones among commutative contracts deemed\u00a0\u1e25al\u0101l\u00a0in Islamic economics. Being a sale of an object not in the possession of the seller\u2014more often than not due to its nonexistence at the time when the contract is being concluded\u2014and with the resulting uncertainty over their ability to deliver the subject-matter, the transaction should theoretically be forbidden under the rules governing\u00a0gharar\u00a0(exorbitant risk\/uncertainty)sales. However, most scholars consider\u00a0salam\u00a0contract permissible on account of a\u00a0\u1e25ad\u012bth, according to which it was allowed by the Prophet himself, as well as the belief that in this particular case \u201cthe requirements of law yielded (rakhkhasa) in face of the people\u2019s need for it\u201d( al-Sarakhsi,\u00a0al-Mabsut, vol. 9). Against this background, during the talk I will trace the provenience of\u00a0bay\u02bfsalam\u00a0and explore the collective thought process that led to its establishment as one of the core Islamic financial contracts.<\/p>\n
